Terms of Service & Escrow Agreement

1. Overview & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Parent", "Student", or "Tutor") and Kalene Education Platform ("Kalene"). By creating an account, booking an educator, or accepting tutorial fees, you acknowledge and agree to be bound by these Terms.

2. The Milestone Escrow Payment System

To ensure fair financial protection for both families and educators, all financial compensation on Kalene operates under the following mandatory escrow provisions:

• Deposit into Escrow: Upon booking, the guardian commits lesson fees into Kalene’s protected escrow account. Funds are isolated from operational funds.
• Block Release: Payment is not transferred in a single lump sum. Instead, payouts are disbursed block-by-block as milestones are completed.
• 24-Hour Review Window: Following a tutor’s milestone completion submission, the guardian has twenty-four (24) hours to review lesson notes and confirm satisfaction or file a dispute.
• Dispute Resolution: In the event of a dispute, Kalene’s academic committee reviews GPS check-in logs, curriculum notes, and parent feedback to resolve the payout fairly.

3. Tutor Verification & Code of Conduct

Instructors approved to accept bookings must abide by Kalene’s Educator Code of Conduct:

• Credential Honesty: Tutors must provide genuine academic degrees, police clearance records, and identity documents. Any forged credential results in immediate lifetime ban and reporting to regulatory bodies.
• Child Protection Zero Tolerance: Any form of physical disciplinary action, abusive language, or inappropriate conduct toward a student will result in immediate police referral and account termination.
• Telemetry Check-in: In-home visits require mobile GPS check-in within the designated student perimeter.

4. Cancellation & Refund Policy

Guardians may reschedule a scheduled session without fee by providing at least four (4) hours advance notice. If an instructor fails to attend a session without mutual agreement, the milestone fee is credited back to the parent’s wallet immediately.

5. Tuition Center Conduct

Students attending physical Kalene learning campuses must comply with campus safety guidelines, respect staff, and utilize biometric identification for check-in and checkout.

6. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Zambia. Any dispute that cannot be resolved amicably through Kalene arbitration shall be submitted to the exclusive jurisdiction of the Courts of Zambia.
